This Privacy Policy (hereinafter – “Policy”) applies to all users of the software products (hereinafter – “The Game”, “Games”) available on Rusty Games game Portal, owned by the company RUSTY GAMES (hereinafter – “Company”), as well as other services of the Company directly related to the Games.

The company in the course of its activity – namely, publication, distribution and management of the Games over the Internet, may get access to confidential information and data of individuals using the Games (hereinafter – the “User”, “Users”) which are recognized as personal data in accordance to the applicable legislation.

  6.   Personal data – any information, related directly or indirectly to the certain User, who is or can be identified from such data;
  7.   Processing of personal data – any action (operation) or a set of actions (operations) performed with or without the use of automation with personal data, including collection, recording, accumulation, storage, clarification (update, change) extraction, use, transfer (distribution, provision of access), depersonalization, blocking, deletion, destruction of personal data;
  8.   Cookies — a small piece of information sent by a web server and stored on the User's computer that the Web client or a web browser sends every time to web server in the HTTP-request when User tries to open the relevant page of the website.

2.1.1. Information that is necessary for the use of the Games

This information is necessary for the adequate performance of the contract between you and us (User Agreement) and to allow us to comply with our legal obligations. Without it, we may not be able to provide you with all the requested services.

  •         Account Information. When you sign up for an account on Rusty Games Portal, we require certain information such as your email or ID in social networks.
  •         Communications with Company and other Users. When you communicate with Company  or use the Games or Rusty Games Portal to communicate with other Users, we collect information about your communication and any information you choose to provide.

You may choose to provide us with additional personal information for the purpose of a better interaction with the Games and Portal.

  •         Additional Profile Information. You may choose to provide additional information as part of your Rusty Games profile (such as gender, preferred language(s), city, and other information).
  •         Other Information. You may otherwise choose to provide us information, for example, when you fill in a form, conduct a search, update or add information to your account on Rusty Games Portal, respond to surveys, post to community forums, participate in promotions, or use other features of the Games and Rusty Games Portal.

2.2 Information we automatically collect from your use of the Games and Rusty Games Portal.

When you use the Games or Rusty Games Portal, we automatically collect information, including personal information, about the services you use and how you use them. This information is necessary for the adequate performance of the contract between you and us (User Agreement), to enable us to comply with legal obligations and given our legitimate interest in being able to provide and improve the functionalities of the Rusty Games Portal and Games.

  •         Geo-location Information. We may collect information about your precise or approximate location as determined through data such as your IP address or device’s GPS to offer you an improved user experience. Most mobile devices allow you to control or disable the use of location services for applications in the device’s settings menu.
  •         Usage Information. Company collects some information about your interactions with the Games of technical and in-game nature, related to the gaming activity, including:
  •  information about logging in to the Game (time and number of logins);
  •  in-game locations visited by User;
  •  purchased items;
  •  sold items;
  •  missions (tasks) accepted by User;
  •  completed missions (tasks);
  •  number of in-game actions, made by User along with other Users;
  •  number of invitations, sent by User to other Users;
  •  amount of virtual in-game currency of the User;
  •  amount of earned and/or purchased virtual in-game currency.
  •         Log Data and Device Information. We automatically collect log data and device information when you access and use the Games and Rusty Games Portal. That information includes, among other things: details about how you have used the Games and Rusty Games Portal (including if you clicked on links to third party applications), IP address, access dates and times, hardware and software information, device information, device event information, unique identifiers, crash data, cookie data.
    We want to inform you that whenever you use our Service, in a case of an error in the app we collect data and information (through third party products) on your phone called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.
  •         Cookies and Similar Technologies. We use Cookies for facilitation of authorization and memorizing the language the User uses in the Games. The Company is entitled to place on its website and websites of the Games cookies and web beacons to collect information about sections of the Games visited by the User and services that interested Users as well as movements within websites of the Games and the Company. If the User is registered, such information shall be stored in the database of the Company. The Company uses this information to improve the performance of the Games, providing users with additional information and services. You may disable the usage of cookies through your browser settings At that disabling the use of cookies in some cases may prevent User from utilizing some functions of the Games. We may also allow our business partners to use these tracking technologies on Rusty Games Portal and in the Games, or engage others to track your behavior on our behalf.

We may employ third-party companies and individuals due to the following reasons:

  • To facilitate our Service;
  • To provide the Service on our behalf;
  • To perform Service-related services; or
  • To assist us in analyzing how our Service is used.

2.3 Information we collect from third parties.

Company may collect information, including personal information, that third parties provide about User, or obtain information from other sources and combine that with information we collect through the Rusty Games Portal and Games. We do not control, supervise or respond for how the third parties providing your information process your personal data, and any information request regarding the disclosure of your personal information to us should be directed to such third parties.

  •         Third Party Services. If you link, connect, or login to your Rusty Games Account with a third party service (e.g. Google, Facebook, VKontakte), the third party service may send us information such as your registration and profile information from that service. This information varies and is controlled by that service or as authorized by you via your privacy settings at that service.
  •         Data for analytics purposes, so we can provide you a better Service;
  •         Data to fight fraud (such as refund abuse in games).

  •         to manage Users’ accounts;
  •         to give Users access to the Games;

  •         to give Users access to additional services, including services the User has subscribed to;
  •         to verify and confirm payments;
  •         to ensure communication between Users;
  •         to provide customer support;
  •         to make changes, additions and improvements to the Games;
  •         to personalize Services we have a legitimate interest to process necessary data to track the content you access in connection with the Services and Users online behavior.
  1.   Terms of storage, processing and disclosure of information and data
  2.            The Company shall keep information and data received from the User in strict confidence and undertake all necessary legal, organizational and technical measures to protect such information from unauthorized or accidental access, destruction, modification, blocking, copying, supply, distribution and other illegal actions in relation to such information and personal data. The Company shall undertake to take all measures to prevent the disclosure or use of such information and data, except as expressly stated in this Policy.
  3.   Personal information and data of the User shall be kept in confidence, except for cases of voluntary provision of such information for general access to the public. The Company is guided by applicable law in the processing of personal information of Users.

  • to provide additional information and services;
  • to ensure processing of financial transactions carried out by the User in the process of using Games;
  • Company has partners to perform services for us. These partners process your data only at and according to Company´s instructions to provide the Service, such as hosting, analytics and fraud prevention.
  • if such disclosure is necessary for the administration of justice, enforcement of judgment, the act of another body or official to be executed in accordance with applicable legislation;
  • the User has given consent to such action;
  • to ensure protection of the rights and legitimate interests of the Company.
  1.      The Company stores information and the User's personal data for as long as it is necessary for the purpose of fulfilment of the User Agreement, compliance with legal requirements, as well as the performance of court decisions.

  3.   The Company, acting in good faith, does not accept and shall not intentionally collect any information and data on persons under the age set by the laws of their country of residence (location) required to use services similar to Services, developed and/or published by the Company, including surname, name, address, telephone number and/or email.
  4.   Persons under the abovementioned age cannot provide their information and data without the required consent of parents or other legal representatives.
  5.   The effect of this Policy and resources of third parties

This Policy applies to the Games, developed, published and/or managed by the Company. The Company specifically states that in some Games we use hyperlinks and banners of third parties, including leading to third-party websites. The Company does not guarantee compliance of such sites with the provisions of this Policy and shall not be responsible for the disclosure of confidential information and/or personal data of the User on such sites.

7.1 Access and managing of Information.

Users may access and update some of information through Account settings. If you have chosen to connect your Rusty Games account to a third-party application, like Facebook or Google, you can change your settings and remove permission for the app by changing your Account settings. You are responsible for keeping your personal information up-to-date.

7.2 Rectification of inaccurate or incomplete information.

Users have the right to ask us to correct inaccurate or incomplete personal information concerning them (and which User cannot update himself/herself within his/her account).

7.3 Data access and portability.

In some jurisdictions, applicable law may entitle you to request copies of your personal information held by us. You may also be entitled to request copies of personal information that you have provided to us in a structured, commonly used, and machine-readable format and/or request us to transmit this information to another service provider (where technically feasible).

7.4 Data retention and erasure.

We generally retain your personal information for as long as is necessary for the performance of the contract between you and us and to comply with our legal obligations. If you no longer want us to use your information to provide Services of Rusty Games Portal to you, you can request that we erase your personal information and close your account. 7.6 Objection to processing.

In some jurisdictions, applicable law may entitle you to require Company not to process your personal information for certain specific purposes (including profiling) where such processing is based on legitimate interest. If you object to such processing Company will no longer process your personal information for these purposes unless we can demonstrate compelling legitimate grounds for such processing or such processing is required for the establishment, exercise or defence of legal claims.

Where your personal information is processed for direct marketing purposes, you may, at any time ask Company to cease processing your data for these direct marketing purposes by sending an e-mail to [email protected].

Our Services is global by nature and your data can therefore be transferred to third parties in other countries, at that we have ensured that appropriate safeguards are in place to ensure an adequate level of data protection. Laws in these countries may differ from the laws applicable to your country of residence.

If you do not cancel your account before the date the revised Privacy Policy becomes effective, your continued access or use of the Companies Services will constitute acceptance of the revised Privacy Policy.
  3.      The present policy and the relationship between Users and the Company arising from the application of the Privacy Policy shall be subject to the applicable law of Hong Kong SAR and other applicable legislation.
